Report: Incognito's grievance aimed at Martin's reps

Suspended Miami Dolphins offensive guard Richie Incognito directed his four-page grievance against the team toward representatives of teammate Johnathan Martin, according to NFL.com.

The grievance was filed Thursday.

Incognito was suspended Nov. 3 for conduct detrimental to the team after Martin, a second-year offensive tackle, left the Dolphins Oct. 28 because of bullying and harassment from Incognito and other teammates.

The introduction of the grievance states, "If any conduct has been detrimental to the team, it is the manner in which Mr. Martin's representatives, including Mr. (David) Cornwell on behalf of his client, have elected to vilify Mr. Incognito and the entire Dolphins organization in the court of public opinion."

Incognito asked neutral arbitrator, Jonathan Marks, for an expedited hearing. It is scheduled for this Thursday in South Florida.

Martin met with NFL investigator Ted Wells for eight hours on Friday. The NFL players union was not involved in the meeting.

Cornwell did not respond to the grievance, but explained in a statement why the union was not included in Martin's meeting with Wells.

"Jonathan and his family decided that it was in Jonathan's best interest to be represented by an independent counsel of his choice," the statement read. "As Jonathan said yesterday, his discussion with Ted Wells was frank and detailed. I was concerned that Jonathan's ability to be frank and detailed would be compromised if there were too many people in the room. We made it clear that our decisions in no way -- in intent or effect -- interfere with the NFLPA discharging its important duties as the exclusive bargaining representative of all players."

Incognito's grievance is an attempt to recover lost wages from his suspension, which equates to $235,294.12 per week. His base salary for the season is $4 million.

The grievance states that "the club's discipline of Mr. Incognito is inappropriate, unreasonable, arbitrary, disparate, inconsistent with principles of progressive discipline and without just cause," and that the interaction between players was "welcome and mutual and reflected the normal manner in which the various players interacted with one another during the one and one-half season that Mr. Martin and Mr. Incognito were teammates."

Other claims listed in the grievance include:

--the suspension came without proper warning;

--the team has been unable to identify any detriment caused by Incognito;

--any detriment to the team was caused by the media strategy employed by Cornwell and other Martin representatives;

The Dolphins have until early December to either reinstate or release Incognito. Only the NFL can extend Incognito's suspension.

Martin is still on the Dolphins' 53-man roster.
