Two of the three claims made against Oklahoma running back Joe Mixon in a lawsuit regarding a 2014 assault of a woman in a sandwich shop were dismissed Monday.

According to the Oklahoman, U.S. District Judge Joe Heaton dismissed Amelia Molitor’s claims of negligence and willful and wanton conduct. Molitor, an Oklahoma student, sued Mixon in July and was seeking damages for negligence, willful and wanton conduct and intentional infliction of emotional distress.

Molitor has 14 days to file an amended lawsuit to get the judge to reconsider those claims, but the judge wrote that he probably would not entertain the amendment.

Molitor’s lawsuit is pending in Oklahoma City federal court.

Mixon, a running back for the Sooners, punched Molitor in the face during an argument in Pickleman’s Gourmet Cafe. Molitor suffered several fractures to her face. Mixon said he was acting in self-defense. Video of the alleged assault was never made public.

Mixon was suspended from the football team for a year and charged with a misdemeanor. A plea deal was reached and Mixon was placed on year-long probation. He also was required to complete 100 hours of community service and undergo cognitive behavior counseling.
