49ers' Smith named in lawsuit

San Francisco 49ers All-Pro linebacker Aldon Smith and Tennessee Titans tight end Delanie Walker were named in a lawsuit filed Tuesday by a man who was shot at a party at Smith's home last year, NBC Bay Area reported.

The lawsuit was filed by Ronndale Esporlas in Santa Clara County, and it claims Smith and Walker, who was then a member of the 49ers, illegally fired weapons on numerous occasions during a party in June 2012.

Smith was stabbed at that party, which was held in the East San Jose.

According to the report, the lawsuit claims Smith and others charged $10 per person for admission to the party, according to one of the victims.

The lawsuit also claims Smith and Walker were legally intoxicated and knew their handguns were possessed illegally.

Smith and Walker came onto the balcony of Smith's home to try to end the party and began to fire shots into the air, according to the lawsuit, which claims Walker fired more shots into the air after moving to driveway.
