The latest crossover of video games, sports, and intellectual property law is materializing from a surprising source – the reproduction of professional athletes’ tattoos in the popular basketball videogame franchise, NBA 2K. Previously, the most high-profile case involving video games, sports and IP law was arguably a class action by college athletes suing the NCAA, the video-game manufacturer Electronic Arts and the Collegiate Licensing Co., for misappropriation of their rights to publicity – i.e. using the athlete’s likeness without their permission in the videogame.
