Dems don't want to take that risky ploy when it means in reverse they could no longer do it and even more so if they fail to win the Presidency and someone with serious balls who hates the establishment and politics as usual gets in a number of current judges could be thrown out for all sorts of reasons There are already 4 SCOTUS judges on very thin ice and the 3 with the thinnest ice are all liberal judges. All of them could technically be removed from the bench for failure to maintain an impartial stance or failure to recuse themselves in the event they were partial. The more Dems play games with the SCOTUS appointment the more likely they will lose hardcore.
