Heat’s Wade seeks dismissal of antitrust lawsuit

WEST PALM BEACH, Fla. (AP)—An antitrust lawsuit against Dwyane Wade(notes) should be dismissed because the Miami Heat star has the right to control licensing of his name and image, Wade’s attorneys told a federal judge Thursday.

But lawyers for Wade’s ex-partners in a failed restaurant venture contended that the NBA star violated antitrust laws by walking away, and they want $90 million in damages from Wade. They argue that when Wade withdrew permission to license his name, he illegally squelched competition for valuable personalized items such as signed basketballs, T-shirts and hats.

Wade’s attorneys told U.S. District Judge Kenneth Marra that a celebrity has never been accused in a U.S. court of wrongly monopolizing his own memorabilia market. Wade’s decision to terminate his deal with partners in the D. Wade’s Place chain was within his rights to license his own image as he sees fit, attorney Robert Turken said.

“If you have a right to give a license, you have a right not to give a license. If you have a right not to give a license, you have a right to take it away,” Turken said.

Marra said he would rule on the request to dismiss the case “as soon as possible” but didn’t specify when.

Bruce Fein, attorney for the former partners, said Wade’s decision to abandon the project triggered the antitrust violation because it removed a competitor in the memorabilia business. D. Wade’s Place was envisioned as a national chain of upscale sports restaurants that would sell Wade items at its locations and on the Internet. Only two Florida locations opened and they quickly closed.

Wade’s contract gave the venture rights to use his name and likeness forever, Fein said.

Wade ranks fifth in the NBA with a scoring average of 27 points per game, and he has lucrative deals with Nike’s Jordan Brand, T-Mobile and Gatorade.

“There are no substitutes for Dwyane Wade personalized memorabilia,” Fein said. “He is a unique market—a single brand. Once he gave the license, my clients invested millions of dollars. All that money was stranded.”

Turken predicted if Wade’s former partners prevailed, dozens of lawsuits would crop up around the country accusing famous people of trying to monopolize their names and images when they withdraw permission for their use.

“You would open the door to an antitrust violation explosion,” Turken told the judge.

Wade, who turns 28 on Sunday, did not attend the hearing. Wade did take part in meetings last year aimed at reaching a settlement, but the talks hit an impasse.

Wade’s former partners have accused him in separate lawsuits of reneging on the D. Wade’s Place contract and walking away from a deal to license his name to for charter schools. The schools for at-risk children are up and running without Wade’s involvement.

    The truth is that no one is better than Wade when he is 100%... these are facts... Also, we have to understand that Wade and LeBron both have admitted that Kobe is a better player than the two of them.... Last season, Wade was All-NBA First Team over Kobe Bryant. So there should be more of a debate between the two shooting guards who will go down as number 2 and 3 best all time after Jordan... There is always an entertaing game When Kobe and Wade meet, even if its just Christmas day.. those games are always entertaining..... LeBron never shows up... his team does.... but Kobe always play better than LeBron even when he has a broken finger....

    If it wasn't for Laker Nation, there would be a bigger debate between the leagues greatest guards who have won something, than an overrated power forard has has yet to win anything...

    Kobe Bryant has admitted that Wade is a tough cover.. He said that Wade is the best player at using his pics, and that it takes a whole team and alot of energy to guard him when he is healthy....

    LeBron later goes on to say "I don't care what anybody says, but You CAN NOT guard a Dwyane Wade when he is healthy...

    when you hear the two talk about Kobe, they talk about his knowledge of the game and how great of a scorer he is and how well he plays in the clutch...

    When the two talk about Lebron, they just talk about his athleticism... He is so big and quick. They also talk about his potential to win more titles than anyone in the history of the game... Hello!!?!? it's been 7 years!! and Wade and Delfino are the only two in that draft to win rings I believe....

    This season, Wade has only played top 5 status... but last season, he was the best guard in the league, and still no one wants to admit that...

    Well said abed. It is all about the rings. You can't crown someone the best if they haven't proved that they can win the big games. Lebron is good but they parade him around like he is God. No one player on a team have won championships without another star player and a supporting cast. It's frustrating for Wade this year. Last year he carried the team on both ends. People can't expect him to do that year after year and not be mentally and physically drained. None of the greats before him was able to do it. They call Lebron great and he is always healthy and he couldn't do it. Surround Wade with talented players who bring it every night and we will see what he can do.
    And on Kobe. I admire his work ethics. He wasn't always the teammate that he is now. That comes from growing and listening and learning from the greats that came before him. Your're never to old to learn. I commend him for passing on his IQ to other up and coming talent like Wade, Lebron, and Carmelo. Then they can do the same as they mature. Also Rom. 3;23 says all have sinned and fell short of the glory of God. He made a sinful choice and have grown from it. If God forgave him who are we to keep kicking him with it. He didn't run from it but he proved himself.He became a better man. That deserves a lot of respect. God can change anybody. He shows His power.Lets stop judging one another; instead start praying fo one another. This nation needs a healing. Only God can heal it. 2 Chron. 7;14. Mercy and forgiveness is what we need to practice Matt. 18;21. God bless.

    great post j, i get sick of all the posters who think a guy's skill level is directly related to the number of rings he has. Luck, staying away from injuries, having good complimentary players, and catchiing teams at the right time all figure in to winning a title

    I agree with AZIZ and disagree with Abed.

    LeBron is a better player. Kobe is a better scorer.

    Abed, if you think it's all about hardware, then Robert Horry is better than Michael Jordan (Horry has 7 rings, Jordan has 6). Since Horace Grant has 3 rings and Barkley has none, is Horace Grant a better Power Forward? Steve Kerr has five rings, that means he is better than Duncan, Shaq, Kobe (all have 4) and as good as Magic (he has 5). That also means Steve Kerr is better than Wilt Chamberlain, Jerry West, and Oscar Robertson. It's really annoying when people say Championships determine how good you are. Championships do not equate to a players skill level. An entire team's talent and dedication equate to a championship. and that is why you cannot use a player\s championships as a measuring stick to greatness. It's a team effort that wins championships, not a single player. If comparing single players, you have to look at stats and makes sure the players are in the same era (you can't compare the 60s to the 90s).

    And Abed, it wasn't Kobe, it was Kidd. Kidd is UNDEFEATED in International Basketball play and has gold medals spanning from 1999 onwards. Check Wikipedia. He is probably one of the only American Athletes that has never lost in International competition.

    For every1 bringing up lebron not shaking hands in the loss to the magics....your idiots. Shaking hands is not a rule and back in jordans era no1 shoke hands specially in the playoffs. Your all crying about this bull@#$% because lebron hasn't done anything wrong and you find the smallest crap and try to turn it big. The media made this nothing into a big deal for no reason because its the media they need news. I wouldn't shake hands either if i averaged 35pts a game and and like 8-10 assists and rebounds during that series while my teammates didn't do @#$%.

    I agree that kobes better than wade but no way is he better than lebron. Jerry West, the guy that brought kobe to the lakers, said that lebron has passed kobe and that lebrons a better all around player. Lebron has been the best player in the league for the past 2 years. The only reason he doesn't have a ring is because he didn't have a sidekick like kobe did and wade. And kobe isn't the reason they won the olympics. Without lebron and others kobe would lose. So stop putting kobe so much higher than every1 else. Kobe is a selfish player. He takes 37 shots and only makes 10 of them...Sad. Besides kobe tries so hard to be like jordan. He imitates his every moves and even trains with his trainer. Lebron on the other hand doesn't try to be anyone but himself and thats why he is the BEST player in the League and will be until he retires.

    You fools on this blog have pissed me off with Wade being better than Kobe Bryant. Wade was quoted by a commentator by calling Kobe a "G" in Wade's terms that means mastering the game of basketball. Wade again was quoted along with LeBron, Carmelo, and Dwight and practically every other TEAM USA basketball player that Kobe helped tremendously by molding all their games. Wade hasn't seen a thirty point average since after the U.S. campaign. In which Kobe guided him along with these other players. Wade. James, Anthony were two time bronze athletes until Kobe came along with Kidd to change that standard. So don't forget that Kobe molded Wade diligently through that experience. Insomuch that Wade is trained by the same trainer that was first notable for Jordan but has been Kobe's trainer for years "Tim Grover". So Wade humbled himself which I can respect because he wanted to be like the best which is Kobe Bryant. Wade was quoted after Kobe won his fourth championship. As saying that himself, James, and Anthony were great players and not taking anything from them respectfully. But "Kobe is the best player in the game today". It hasn't been the first time Wade has said it. Even LeBron and Carmelo have been cited saying it many times. So to say that Wade is better than Kobe is farfetched and isn't basketball savvy. Yes Wade to his credit has won a 2006 Finals M.V.P. during Kobe's tenure. As well as a 2006 Championship so much props to him. In my personal opinion he is the second best shooting guard, and second best player in the league. Not LeBron because in my book it's all about hardware (championship) and how many you can win as being the focal point. LeBron hasn't done these things so he shouldn't even be in the same breath with these guys. But Kobe is the best with four rings and possibly with this team can win number five, six, and to stretch it seven. So stop saying Wade is better until he gets to Kobe's level.

    P.S. for anyone who refutes this by saying Kobe had Shaq or Gasol. Well Wade had Shaq, Jordan had Pippen, Magic had Kareem, Bird had McHale,Parish,Johnson, Isaiah had Dumars, Rodman, Lambeer. West had Chamberlain, Havilcek had Russell. All the greats had another great player along side them to win. So I'm tired of people using that argument because hadn't it been for your favorite player having another great player around them they wouldn't win anything. Thats common sense because basketball is a team game not individual game. Even though you need that one special player!

    this looks like typical US business - someone has a marketable skill, capitalizes on it, then a bunch of people who are skilled in the art of "business" come in and take slices of the pie.............I'm sad to see it happened, but hopefully dwade learns from this experience and aligns himself with better human beings in the future.

    WHOA! where is this.... dwade is better than kobe thing come from? this isnt even about kobe. but you guys must be watching games with stevie wonders eyes. look d wade is a very good player. maybe even a future hall of fame player. but come on. if you really know basketball then there isnt an arguement that kobe is and has been the best the player the league has seen since michael jordan retired......the second time. player efficiency rating? wft!? hows this for efficiency? kobes played 13 years in the NBA. he's played in 5 nba title series. his teams have only missed the playoffs once, maybe twice in his career. dwade lead the league in scoring last season. great. check kobes highest scoring seasons average. which no one has come close to since mike jordan was well mike jordan. dwade blocks shots as a guard, ill give him that but check n see how many all defensive teams wade has made compared to kobe. when kobe scored 81 points in a game, which no one, not even jordan, has done other than wilt,kobe still held the guy he was guarding that game to 7 points under his average. lebron might be the next best player. lebron has learned that the truly great players, played on both ends of the floor. right now dwade gambles alot on defense and is late getting back whic is why he blocks shots from behind.

    D-Wade is better than Kobe the rapist--evidence was withheld--Kobe had good Image saving lawyers and $$$...D-Wade is far better player-off court person than Kobe==childish at 30+ years old..He didnt even invite his Parents to his wedding when he married the (white girl) I am sure his parents had some reservations about that move..and if it wasnt for his Dad--(Joe Bryant going to Italy) Kobe would not know nothing about basketball he is a ungrateful and lousy Son!!!!!     @ bencamerondavis...IF you had read the original article here back in July, you would know that this is about DWade keeping $100,000 that was supposed to be used for enticing other investors....Instead, when they backed out, he kept the money....He was supposed to have returned it to the people who gave it to him to use for a very specific purpose...this is NOT from early on in his career, but from about a year or so ago...this is also why-to answer your question on another blog-DWade has been flying under the radar most of the summer....NOT because "the media" are out to get him like you think...Keeping a hundred grand of someone's money kinda makes "not being a good loser" pale in comparison...doesn't it?...and about that...a little quote from Vince Lombardi... ya know..the guy the Super Bowl trophy is named after...."Show me a good loser, and I'll show you a loser"...and I'm STILL waiting for you to answer my post on that other blog like you said you would...just try bringing a few facts this time.....YOU ARE A FRAUD!!!

    #74, you must be a Wade fan and not look at the facts. You can not get into Business without reading and signing a contract. You can't just walk away from anything and think that its going to go away. D wade is not Better than Kobe in no strecth of the imagination. He is a great player , but still an immature person. Kobe did not rape anyone and the evidence proved that she had two other person semen in her panties. Ben Rothlisberger probably did not rape that girl in Nevada, but you dont hear much rumblings about it. Therefore, your points are not credible, because the start with a false premise. What support do you have to say D Wade is better than Kobe other than how you feel. You cant legislate teammates and say he would have won. He had Shaq. He won one championship. Kobe has 4 championships, three with Shaq, and one with out Shaq. How many has D -Wade won without Shaq? He had Shawn Marion, Michael Beasley, and several good players. The fact is he is injury prone and at 6'4 he is a good player, sometimes great player and defender but he may not be better than Labron, but D Wade will not win another championship in Miami. Perhaps if he goes to NY with Labron they might win another, but then you can't make the argument about Kobe. the point in business is that it is your responsibility to know and ignorance is not a DEFENSE in the Court of Law.
