Trial delay in Angels pitcher Adenhart murder case

SANTA ANA, Calif. (AP)—The trial of a man charged with driving drunk and killing Los Angeles pitcher Nick Adenhart(notes) has been delayed for six months at the request of his new defense attorney.

On Friday, Superior Court Judge Richard Toohey rescheduled the trial for 22-year-old Andrew Thomas Gallo to April 19, 2010, to give Deputy Public Defender Bryan Harris time to prepare a defense. Harris was appointed after Gallo’s private attorney quit the case.

Prosecutors had hoped to go before a jury later this month.

Gallo is charged with three counts of second-degree murder for an April crash that killed Adenhart and two others.

Authorities say Gallo was drunk when he drove his minivan through a red light in Fullerton and hit another car.

He could face nearly 55 years to life in prison if convicted.

    This guy's attorney is a fool. Gallo stands no chance in front of a jury of ordinary people. When the prosecution compares the three young people he killed to a two time drunk driver kicked out of rehab for a 'gangbanger attitude' it will be lights out. And that is the way it should be. I hope he finds a way to be of use to society, but I also hopw he does it from a jail cell for the better part of his life.

    Why can't some people leave Courtney alone?? Fry the scum that killed her, Nick, and Henry, and let them rest in peace!!! That scum gallo deserves everything he gets and then some. Even if she did have a drink that night, so what? She was doing NOTHING WRONG!!! I would love to be on the jury for this trial. That scumbag gallo wouldn't stand a chance of getting off again. That scum knew what he did was wrong, and frankly, deserves to be in prison for the rest of his sad, miserable life, constantly watching home videos of Nick, Courtney and Henry so he finally realizes just how much horrible pain this scum caused. GO ANGELS!!!! Rest in peace Nick, Henry, and Courtney!

    Wonder what kind of a defense this loser is going to end up utilizing. Bet his attorney works the system for all he can. This guy should be convicted of motor vehicular homicide. He made the choice to drive drunk. He deliberately ran a red light. He killed someone.

    He'd been made to sign documentation saying he knew the consequences that he would get, should he drive while intoxicated again.

    There should be no defense at all.

    This person lost all of his rights, when he violated his own agreement.

    If he gets anything less than life, it will be a huge miscarriage of justice.

    But hey, this is the same state that couldn't prosecute OJ correctly, so good luck handling this one correclty.

    Some of the comments here would be understandable of we were talking about pre-high school aged people. Now I'm sure Nick was a great guy, and it breaks my heart to see him gone. However, those who come here and all they can say is, torture and murder the bastard who got drunk and killed him, well, those people really disgust me more than the kid who got drunk. If you don't know why, I'm not surprised.

    The one problem here is there is a NFL player out there that did the same thing killed a person and only spent 30 days in jail paid off the family lost in license for Life BIG DEAL. And can come back and play in the NFL in a year were is the justice in this world. This guy will spend a lot of time in Jail for what he did which is how it should be. But it goes to show you if you have money you can get out of anything.

    Iam not a angels Fan but I hope they Kick some Yankee Butt. Good Luck Angels but remember what Killed your team mate and be smart. Lets not see so much Alchol when you clinch the American League Series.

    Julia#347 just to clear this up...thats not correct. 1.0 BAC means one per cent. if the reading was 0.10 thats one tenth if one percent, enough to be hammered. Even 1.0 is fatal, matter of fact half of that , 0.50 is fatal alcohol poisoning. if BAC read 100% THEN your blood is 100% alcohol..
    This is really a meaningless technicality , I am not defending anybody, just trying to clear up that misconception of how little an amount of alcohol it takes to be impaired

    Even with a 0.06 level, you can still be of age & DWI if the officer determines you were "intoxicated", the legal limit just gives the officer a level where you are "presumed intoxicated." But the girl was 20, so she was obviously over the limit for a minor...

    I really believe that if it was a 18 y/o suburban white girl that was driving drunk w/out a license & killed someone, that people would not be calling for her head... Usually I am the last to play the race card, but I'm playing it.. as well as the sex card..

    The fact of the matter is Gallo was driving with out a license. Why? because he had a prior conviction for DUI that he was still doing alcohol classes and community service for. Gallo new he wasn't supposed to be driving a motor vehicle sober let alone drunk. So I say he should pay for what he has done. He should get the death penalty. As for being measured by our own measuring stick absolutely. That is the problem with the system, we do not hold people accountable for their actions. Also remember driving is a privilege not a right, I think a most people forget about that. Think about this what if it was your loved one that was killed by this convicted drunk driver that did not have a license, and was driving drunk again. Then there is the fact that he ran from the scene, which proves that he new he was in the wrong. Who cares if the other driver was under the influence she is dead. Its obvious she has paid the ultimate price for her decision so why shouldn't Gallo. I am all for second chances. It seems to me Gallo had his second chance and he blew it. He made his choice make him pay for it. I say fry him.

    I wonder what you would be posting if the shoe was on the other foot and Nick would have been at fault. People make mistakes and people die. He should be punished, but many of you may also be there one day. Do you want to be judged by your own yardstick? Think about it!

    Legally Gallo DID NOT have the right of way. So it doesn't matter if the others were intoxicated. What are you gonna do? Prosecute a dead man? Impossible.

    @Everyone else

    I can't wait to see Callo thrown into a dark hole for what he did. He deserves it.
