KU wants suit by ex-rower alleging rape by football player dismissed
The University of Kansas has asked for the lawsuit against it by a former rower at the school to be dismissed.
Daisy Tackett filed a Title IX suit against the school after she said she was sexually assaulted by a former football player in the Jayhawker Towers dorm. KU filied a motion for dismissal Friday.
“The incident is tragic, but it is not one for which Title IX makes the university liable,” KU said via the Kansas City Star.

Tackett sued the school in March and said she was sexually assaulted in November 2014. In her suit she said Kansas was "deliberately indifferent to the sexual harassment of a student by another student." The charge of indifference is similar to the claim made by a former Baylor student in her lawsuit against Baylor. The woman at Baylor said she was raped by former football player Tevin Elliott, who is currently serving a prison sentence for rape.
KU is also claiming, per the Star, that it didn't know of any previous accusations of sexual assault against the unnamed football player and that it investigated her claim when it was made aware of it. The player has been expelled from the university.
Tackett is asking for $75,000 in damages. She has also said she came forward after she found out another rower was allegedly sexually assaulted by the same player in August of 2015. That former student has also filed a Title IX suit against the school and said KU made her feel "worthless."
